since the announcement of judge k as the next high crt justice. I wanted to read up on, settled law as well as whether roe is settled and or is roe constitutional ?

the following speaks clearly on both questions. while is a long copy and paste .I wanted the entire article to be read.

seems to me there are many areas of the original decision that would not stand up if challenged. I can see a test case coming very soon, maybe nexr year.

the seems to be a breach of the states rights.

well it is for smarter legal minds to explore.

prediction!!!! we will see roe over turned before trump leaves the mantel to pence

Roe v. Wade is Not “Settled Law,” Someday the Abortion Abomination Will be Overturned. Here’s Why

Opinion Clarke D. Forsythe, J.D. Apr 6, 2017

It’s a tragedy for the Supreme Court and the American people that Supreme Court confirmation hearings have been so terribly skewed for 45 years by undue emphasis on one case, Roe v. Wade. We should hope that one day Roe v. Wade is overturned, and the abortion issue returned to the people, so that the range of important constitutional and federal issues can be given proper treatment in the assessment of Supreme Court nominees. But that is not where we are today.

In her opening statement on day one of the Supreme Court confirmation hearings for Judge Neil Gorsuch, Senator Dianne Feinstein (D-CA) singled out Roe v. Wade—the Supreme Court’s 1973 decision that legalized abortion for any reason, at any time, in every state—as the most important Supreme Court decision that she wanted the judge to keep, saying it was “super precedent” because it had been affirmed in 39 cases.
That false claim cobbles together cases in which Roe was merely cited or applied, not reaffirmed on the merits. (The actual number of decisions in which Roe was “reaffirmed” is 3, not 39.) More importantly, Senator Feinstein’s claim ignores many other factors that show that Roe is the most unsettled constitutional decision of the past 50 years.
Roe is unsettled by the Justices’ own inconsistency in their application of Roe’s abortion doctrine, and its detailed standards, over the past 44 years. That, in turn, has sown inconsistency and confusion among the lower federal courts.
In fact, Roe 1.0—the original opinion including the original rationale for Roe—is defunct, discarded in the Casey decision of 1992. The historical rationale for Roe—the legal justification for its connection to the Constitution—was replaced by a new sociological rationale created in Casey—the assumption that women have come to rely on abortion as a back-up to failed contraception.
Roe is unsettled because the original opinion and rationale have never been persuasive. The Court abandoned the original rationale by 1989. Abortion-rights activists have spent the past 44 years looking for a new constitutional hook for Roe—the equal protection clause? the Nineteenth Amendment that gave women the vote in 1920? Or (my favorite) the cruel and unusual punishment clause?
Roe is unsettled in public opinion. Public opinion polls periodically show majority “support” for Roe, but only when Roe is intentionally distorted and mischaracterized as only legalizing abortion in the first three months of pregnancy. A majority of Americans oppose abortion after the first trimester.
A February 2017 poll, commissioned by the Human Family Research Center and conducted by the Polling Company, found that Americans were almost evenly divided when they were told that overruling Roe would leave the abortion issue to the states (45% reconsider, 49% continue to follow, with 5% undecided).
The abortion rate, according to 2014 figures, has dropped to its lowest level since 1973. Women still seek approximately 900,000 abortions or less a year, but more than half of these are repeat abortions, and millions of women haven’t had an induced abortion and never will. If women “rely” on anything, it’s contraception, not abortion.

Roe is unsettled in medical practice. Ultrasound came on the commercial market a few years after Roe and permanently changed medical practice and public understanding.
Roe is unsettled because American doctors have abandoned abortion. Few will do it. Women go to an abortion provider for an abortion but another gynecologist for everything else. It’s long been a myth that abortion is “between a woman and her doctor.”
Roe is unsettled by its extremely narrow focus. It has nothing to do with contraception (which is independently protected by other decisions of the Court) or with women’s health care. It’s about a “right” to “terminate pregnancy” and nothing more.
Roe is unsettled by state protection for prenatal human beings in property, prenatal injury, wrongful death, and fetal homicide law. Despite Roe, the states have moved ahead with state legislation and judicial decisions that treat the unborn child as a human being from conception, creating considerable schizophrenia. Twenty-five states now have a fetal homicide law that treats the killing of an unborn child (outside the context of abortion) as a homicide—from conception.
Roe is unsettled by a growing body of international medical data finding increased risk of pre-term birth, mental trauma, and breast cancer after abortion. And, in recent years, statistical studies from Ireland and Chile have provided evidence that abortion prohibitions do not compromise women’s health and that legalizing abortion does not positively impact women’s health.
Roe is unsettled because the Justices cannot perform their self-appointed role as the national abortion control board, created when the Justices in Roe drafted a new, detailed national abortion law, which binds every state and local government in the country.
Roe is unsettled because other nations have not followed its sweep. The U.S. is one of only 4 nations of 195 across the globe which allows abortion for any reason after fetal viability, and one of only 7 that allows election abortion after 20 weeks.
The mere passage of time does not settle a Supreme Court decision. Roe is 44 years old. But Plessy v. Ferguson (1896) (which affirmed racial segregation) was 58 years old when it was overturned in Brown v. Board of Education (1954). Several other decisions were older when they were overturned.
Roe is unsettled in politics. One major party has opposed the decision in its party platform since the 1970s.

And just last year, the nation elected a presidential and vice-presidential candidate who promised to appoint “pro-life” justices and to “overturn Roe v. Wade.”
Dozens of other decisions by the Supreme Court were not mentioned during the Gorsuch hearings because they are so unquestionably settled that no one needs to raise the question.

To ask the question, “Is Roe settled?” is to answer it.

credit goes to mr forsythe.

this is a quote from the comment section of a news article .

seems to sum up things well.

"Blacks and Asians were both treated terrible. The difference is that blacks by an large dwell in the past and seek to blame people for their own failures. Asians on the other hand look to the future and seek ways to improve their future."

SUPREME COURT NOMINEE

I READ A STORY , PRETTY MUCH CENTERED AROUND TH E HIGH CRT VACANCY.

much of it was the alarm and shock that trump has appointed 1 now 2 and maybe 3 to the high crt.

I thought the following was worth a copy and paste.

President Obama’s destruction of his party has largely been overlooked by Democrats, but his indifference to the future of the Supreme Court is an act of political malpractice impossible to ignore.

Recent Supreme Court rulings have not gone well for Democrats. These include Janus v. AFSCME (the American Federation of State, County and Municipal Employees), which could undermine the influence of public employee unions that generally support Democrats in elections; the upholding of President Trump’s travel ban on countries that pose a national security risk; and the ruling in favor of a baker who refused to produce a wedding cake for a same-sex couple.

These decisions and others hint at the influence of the new conservative Supreme

Court, and the damage that will done to the progressive movement.

And the retirement of Justice Ginsburg could be next.

THE SILENT SCREAM

The Silent Scream is a 1984 anti-abortion educational film directed by Jack Duane Dabner and narrated by Bernard Nathanson, an obstetrician, NARAL Pro-Choice America founder, and an abortion provider before becoming a pro-life activist, and produced in partnership with the National Right to Life Committee.[2] The film depicts the abortion process via ultrasound and shows an abortion taking place in the uterus. During the abortion process, the fetus is described as appearing to make outcries of pain and discomfort. The video has been a popular tool used by the pro-life campaign in arguing against abortion,[3] but it has been criticized as misleading by members of the medical community.[4]

HOW DOES ONE MISLEAD TEARING APART A BABIES BODY

IT WAS NOTED THAT THE IMAGES SHOWED A NEAR FULL TERM BABY, NOT A 12 WEEK OLD.

WELL MY THOUGHT IS THIS. LIFE BEGINS AT CONCEPTION. THIS HAS BEEN PROVED AND IS AVAILABLE . SO ITMATTER NOT THE AGE.

IT IS MORDER OF A HEALTHY BABY DUE TO SOME POS THAT WANTDD SEX AND THE THRILL THAT COMES WITH IT BUT NOT THE BABY.

FORCED STERLIZATIONS WOULD BE THE CHOICE HERE

Nathanson, a pro-life obstetrician, serves as both the medical expert and narrator of the film, describing the events of the abortion as they unfold. He begins by stating the viewer is about to witness the "dazzling" new "science of fetology" and to witness an abortion in real time "from the victim's vantage point."[9] The film compiled a series of still ultrasound images of the abortion of a twelve-week-old fetus, which Nathanson describes as "a child," spliced together to create the video.
Nathanson displays the instruments used in a typical abortion and calmly demonstrates how each instrument is introduced into a woman’s body during an abortion. Nathanson claims that the head, even at 12 weeks' gestation, will be too large to enter the suction device and shows how forceps are used to crush the skull. He suggests that brain waves have been active for six weeks though that is disputed by scientists.[10]
Nathanson then sits by a television screen showing ultrasound images of a fetus in its mother’s womb. As the images of an abortion appear on the screen, Nathanson describes step-by-step what is taking place, pointing out new instruments that are introduced into the womb. The suction cannula is described as a lethal weapon that will "dismember, crush, and destroy" what Nathanson refers to as "the child." Nathanson goes on to narrate that the fetus is unprepared for the invasion of the womb and attempts to escape the cannula, describing it as a "child being torn apart ... by the unfeeling steel instruments of the abortionist."[11] He notes how the fetus's heartbeat speeds up and how it seems to open its mouth in a "chilling silent scream."[11] Though scientists dispute this as well. The film culminates in the now-famous "silent scream" which is accompanied with shrill musical accompaniment.[9

Legacy
The Silent Scream has been credited with winning "many converts to the pro-life cause" by its graphic scenes that shocked many viewers.[24] The film helped "to shift the public focus from the horror stories of women who had suffered back-alley abortions to the horror movie of a fetus undergoing one."[25] The film has been very important for the pro-life movement and is widely available for purchase or download.[26]
Nathanson later produced a follow-up film, Eclipse of Reason, depicting a late-term abortion procedure known as dilation and evacuation (D&E).

MR JIMMIE DICKINS ROTE THIS.

DAVID WILKINS SANGS IT SO PURTY. CATCH ON YOU TUBEY

Just a bowl of butter beans
Pass the cornbread if you please
I don't need no collard greens
All I want is a bowl of butter beans

Just a little piece of country ham
Pass the butter and the jam
Pass the biscuits if you please
And some more of the good ol' butter beans

Bread and gravy is alright
A turnip sandwich is a delight
But my children all still scream
For another bowl of butter beans

When they lay my bones to rest
Place a rose upon my chest
Plant those blooming evergreens
But all I want is a bowl of butter beans

(Chorus)

Crossin' the highway late last night

Dead skunk in the middle of the road
You got yer dead skunk in the middle of the road
Stinkin' to high Heaven

Take a whiff on me, that ain't no rose
Roll up yer window and hold yer nose

You got yer dead skunk in the middle of the road

I copied and pasted the entire article toshow how these scam thug use seniors.

I have afreind that lost 1000 to a scammer.

there is a special place in hell for these things, thye are not human

NASHVILLE, Tenn. (WKRN) - - Mary is 77-years-old, a mother, grandmother and now, a job hunter.
She lost her entire life savings and even faces trouble with the IRS all because she thought she found a friend on Facebook.
It all started with a birthday wish from a stranger.
"It was a pleasant surprise, nice looking man, and we began messaging back and forth," recalled Mary.

Mary accepted a person who called himself Lucas Spence as a Facebook friend. She said it wasn't long before the messages turned into emails and finally texts.
"We took up a friendship and learned about each other's families and it was fun."
A few weeks in, the conversation shifted from family to finances.
"It progressed when he told me he was going to Southeast Asia to bid on a contract for oil exploration and that he had spent all his money to get this contract and he needed some money," explained Mary. "Well, that should have been the last I ever heard of him, but I chose to believe him even though it sounded to me like a scam."
Mary even asked him if it was a scam.
"I said, 'Are you a catfish?' And he said, 'I'm not a catfish. What's catfish?' I wanted so much to believe."
Spence was charming, attentive and convincing.
"Oh the promises," said Mary. "The, 'You're so wonderful, I love you, I know even just looking at your picture,' blah blah blah, it's sort of a standard script, I think."
Mary opened her heart to him and he emptied her wallet.
"I kept sending money thinking any minute, the contract will be up, and we will get our money back. He will be paid, and we will get our money back," said Mary. "It became almost desperation, throwing money at this person and of course, having run out of money, I'm not of any interest to him anymore."
Mary gave him $130,000 - everything she had.
"I don't have money to take care of myself or should something dire happen," she said.
After she told Spence she had nothing left to give, he kept asking, even contacting her during the interview with WKRN, wanting a $100 iTunes gift card.
"At one point I told him, 'I'm going to turn you into the FTC and the FBI, the police have already been here, and he said, 'I'm not afraid of you. You will never find me.'"
Mary said she is sharing her story in the hopes that no one else will have to go through what she has.
"I would say be very careful, not to get isolated. Whatever you do, go out in the community, find a friend, find something to do. Do not stay at home," said Mary.
"This is one of the few times in my life I have been lonely. It makes you very susceptible to all kinds of things, and a scam is the most devastating."
Mary turned to her family and FiftyForward for help after she realized she was the victim of a romance scam.
